SC overturns NA-251 result, declares Khushal Khan winner

ISLAMABAD (Dunya News) - The Supreme Court of Pakistan has declared Khushal Khan as the returned candidate from constituency NA-251 in the general elections and directed the Election Commission of Pakistan to issue his victory notification.

The case was heard by a three-member bench headed by Justice Shahid Waheed.

During proceedings, lawyer Salman Akram Raja informed the court that the case revolved around Form 45.

He pointed out a clear discrepancy between Form 45 and Form 48 of 10 polling stations, stating that 100 votes were reduced from his client at each polling station, while the votes of the opposing candidate, Syed Samiullah, were increased in Form 48.

Justice Naeem Akhtar Afghan remarked that whoever devised the formula kept the difference at exactly 100 votes and observed that such actions are often easier to carry out at night. Salman Akram Raja responded that such actions could also take place during the day.

During the hearing, Form 45 documents from 10 polling stations were presented before the court.

The counsel argued that action should be taken against the Returning Officer (RO) for issuing incorrect results.

Justice Naeem Akhtar Afghan questioned whether any action had ever been taken against an RO in the past for issuing wrong results.

Officials from the Election Commission informed the court that a complete chapter exists regarding action against ROs and that they carry significant responsibility.

After completing the hearing, the Supreme Court declared Khushal Khan as the successful candidate and ordered the Election Commission to immediately issue the notification of his victory.
