SHC to hear plea against 26th Amendment

Court seeks answers from respondents including AG Pakistan, Sindh Advocate General, others
KARACHI (Dunya News) – The Sindh High Court (SHC) on Thursday fixed plea against passage of the 26th Constitutional Amendment for hearing.
SHC Chief Justice Muhammad Shafi Siddiqui heard the petitions against the recently passed amendment where he remarked that the constitution was a matter of the parliament, not judiciary, wondering if the applicant had read the Article 239 of the constitution.
He further told the applicant about the SHC’s limited authority in this regard, adding that the lower courts couldn’t supersede the authority of the Supreme Court.
He went on to say that the parliament was elected by the people of Pakistan unlike courts.
Later, the court sought answers from respondents including the Attorney General of Pakistan, the Advocate General Sindh and others within two weeks.
It must be noted that 26th Constitutional Amendment was challenged in the SHC soon after its passage in both houses of the parliament.
