ISLAMABAD (Dunya News) – The draft of constitutional amendment that was passed by the special committee of parliament appeared on Friday.
There are 26 amendments to the approved draft that is expected to be brought in parliament.
The formation of constitutional bench has been proposed in the new draft.
The draft said the judicial commission would decide the number of constitutional benches and judges.
The suo motu powers would rest with the constitutional benches according to the proposed amendment to Article 184.
All the constitutional cases would be heard by the constitutional benches as per Article 185.
The draft includes a proposed amendment to Article 48, ensuring that advice sent to the president by the prime minister and cabinet cannot be challenged in any court.
The proposal to increase the number of judicial commission members has also been given in the new draft.
Four senior-most judges of Supreme Court along with the chief justice will be members of judicial commission.

Moreover, Law Minister, Attorney General and a nominee of Pakistan Bar Council (PBC) will also serve as the members of judicial commission.
It has also been proposed to include two members each from the National Assembly and Senate in the judicial commission.
Both the government and opposition will have one each member from the Senate and National Assembly.
The special parliamentary committee on Friday approved the 11-page draft which would be presented in the cabinet meeting.
The special committee's meeting took place in Parliament House.
Meanwhile, amendments were proposed to Articles 38, 48 and 81.
The Chief Justice of Pakistan will be appointed from amongst the three senior-most judges. The CJP will be appointed on the recommendation of the special parliamentary committee.
The parliamentary committee for the appointment of chief justice will consist of 12 members.
The 12-member committee will have eight MNAs and four Senators.
The prime minister will forward the name of chief justice to the president for approval.
The CJP will be appointed for the term of three years, said the draft.
