ISLAMABAD (Dunya News) - Pakistan Tehreek-e-Insaf (PTI) has challenged the dismissal of its petition against the Practice and Procedure Ordinance 2024.
PTI Chairman Barrister Gohar has filed an appeal against the constitutional bench’s December 12, 2024, decision, making the President of Pakistan, the Cabinet Secretary, and the Law Secretary respondents in the case.
The appeal request the court to overturn the December 12 ruling, arguing that sections 2, 3, 4, and 5 of the ordinance are unconstitutional. It also seek to declare all actions taken under the ordinance illegal.
Last month, the Supreme Court’s constitutional bench had dismissed PTI’s and others' petitions against the ordinance.
During the hearing, Justice Aminuddin Khan noted that the ordinance had expired, while Justice Muhammad Ali Mazhar highlighted that Parliament had since legislated on the matter.
Justice Jamal Mandokhail remarked that once a law is enacted, an ordinance automatically becomes void. He further stated that the committee formed under the ordinance had been dissolved, with its decisions now protected as past and closed transactions.
