Summary Islamabad High Court overturns rulings declaring Pakistan Naval Farms and Naval Sailing Club illegal, including demolition and proceedings orders.
ISLAMABAD (Dunya News) – The Islamabad High Court has issued a major ruling, nullifying a decision that had declared the Pakistan Naval Farms and Naval Sailing Club, located along Rawal Lake, illegal.
The court also set aside the decision to demolish the building of the Naval Sailing Club, as well as the ruling ordering misconduct and criminal proceedings against former Chief of Naval Staff Admiral Zafar Mahmood Abbasi.
A division bench comprising Justice Inam Amin Minhas and Justice Shahrukh Arjumand accepted petitions challenging the 2022 single-bench judgment of former Islamabad High Court Chief Justice Athar Minallah.
The Ministry of Defence, former Naval Chief Zafar Mahmood Abbasi and others had filed appeals against the single-bench ruling.
Advocate Ashtar Ausaf appeared on behalf of former Naval Chief Zafar Mahmood Abbasi. The court also nullified the order directing the Auditor General of Pakistan to assess the loss caused to the national exchequer and recover the amount from the officers allegedly responsible.
The court further set aside the order declaring the transfer of land for the Naval Farms in the name of the office of Pakistan Navy Headquarters illegal.
Advocates Ashtar Ausaf, Sardar Ahmed Jamal and Abdul Wahid Qureshi appeared on behalf of the petitioners, while the Additional Attorney General, Assistant Attorney General and counsel for the Capital Development Authority (CDA) represented the federal government.
